Process of Trademark Registration for Cosmetic Products

• Trademark Search

  Perform a detailed search on the IP India Trademark Database to verify that your cosmetic brand name or logo is not already registered or similar to an existing one in Class 3.

• Choose the Type of Trademark

  Select what to protect — your brand name (wordmark), logo or symbol (device mark), product packaging, or slogan.

• Prepare the Required Documents

  Gather the owner’s identity proof, business registration documents, address proof, and a clear logo image in JPEG format. If you are filing through an agent, prepare the TM-48 authorization form.

• File the Application (Form TM-A)

  Submit the trademark application online through the IP India E-Filing Portal using a Class 3 Digital Signature Certificate (DSC).

• Pay the Government Fees

  The government fee is ₹4,500 for individuals/startups and ₹9,000 for companies or LLPs, per class.

• Receive the Application Number

  Once filed, you’ll receive an acknowledgment and TM number. You can immediately start using the ™ symbol with your brand name.

• Examination by Registry

  The Trademark Office examines your application for compliance and distinctiveness.

• Publication in Trademark Journal

  After approval, your mark is published in the Trademark Journal for four months for public opposition.

• Registration & Certificate

  If no opposition arises, the Registrar issues the Trademark Registration Certificate, allowing you to use the ® symbol legally.
